FCC Cable Bureau sent Time Warner Cable (TW-Cable) rate case back to Cabarrus County, N.C., board of commissioners, saying they hadn’t justified their denial of increase. TW-Cable sought to raise its local rate for basic service and county board’s consultant agreed it was warranted. However, commission voted 3-2 against it. Under FCC rules, local entity can do so as long as it bases its denial on Commission’s rules on rates. FCC said local franchising authority, in this case county commission, couldn’t deny rate request if it didn’t dispute cable operators’ figures and hadn’t found any mathematical errors. FCC sent case back to county commission for reconsideration.
