BIS Final Rule Implements Wassenaar "Editorial" Revisions

The Bureau of Industry and Security has issued a final rule, effective December 10, 2009, which revises a number of entries on the Commerce Control List (CCL) to implement certain editorial revisions agreed upon by the Wassenaar Arrangement Task Force on Editorial Issues (TFEI) to the Wassenaar List of Dual Use Goods and Technologies.

The TFEI revisions (over 2,000) were agreed upon by the Wassenaar Arrangement in December 2007. Some of these revisions were made by BIS' final rules implementing changes from the 2007 and 2008 Wassenaar Arrangement Plenary Meetings. This final rule implements the remaining TFEI revisions not included in either of the previous WA final rules.

BIS Final Rule Makes Editorial Revisions to Over 70 ECCNs

BIS' final rule amends the following ECCNs:

Savings Clause

Shipments of items removed from license exception eligibility or eligibility for export without a license as a result of this regulatory action that were on dock for loading, on lighter, laden aboard an exporting carrier, or en route aboard a carrier to a port of export, on December 10, 2009, pursuant to actual orders for export to a foreign destination, may proceed to that destination under the previous license exception eligibility or without a license so long as they have been exported from the U.S. before approximately February 8, 2010. Any such items not actually exported before midnight, on approximately February 8, 2010, require a license in accordance with this regulation.
