AES Edits Adjusted for Certain BIS Wassenaar Revisions

The Census Bureau has issued an Automated Export System (AES) broadcast regarding the Bureau of Industry and Security's adjustment, effective December 11, 2009, of the AES edits on certain Export Control Classification Numbers (ECCNs) and AES License Types C35 - LVS and C38 - TSR as a result of its December 11, 2009 final rule implementing certain Wassenaar Arrangement revisions.

AES Filers Must be Aware of Edits to Prevent Return of Fatal Errors

Census states that AES filers must be aware of the following edits to prevent the return of fatal errors from AES:

New ECCN 1A008 added to the Commerce Control List (CCL)

New ECCN 1A008 added to the list of ECCNs eligible for License Type C35 - LVS.

ECCN 4D003 no longer eligible for License Type C38 - TSR.

BIS sources have confirmed that the three edits listed above are for the only December 11 Wassenaar revisions that would affect fatal errors in AES.

(Census states that a complete list of valid ECCNs and their descriptions, as well as license exceptions, is available in 15 CFR 774, Supplement 1.)

Census states that filer that are unable to resolve fatal errors related to the above and require regulatory guidance from BIS should contact BIS' Office of Exporter Services at one of the following locations:

Western Regional Office(949) 660-0144
San Jose, CA Branch(408) 291-4212
Headquarters, Washington, DC(202) 482-4811

(See ITT's Online Archives or 12/09/09 news, 09120925, for BP summary of BIS' Wassenaar final rule.)
