Fact Discovery in FTC’s Suit vs. Kochava to Be Complete by Jan. 15

Jan. 15 is the deadline for completing fact discovery in the FTC’s privacy lawsuit against app analytics company Kochava, said a discovery plan (docket 2:22-cv-00377) filed Wednesday with the U.S. District Court for Idaho in Boise. March 18, 2024, is the deadline for completing expert witness discovery, it said. The parties agreed to the terms of a protective order to safeguard trade secrets and other sensitive information, and will submit that to the court for approval, it said. The agency is seeking a permanent injunction enjoining Kochava from acquiring consumers’ precise geolocation data and selling it in a format that allows entities to track their movements to and from sensitive locations (see 2212050061). Kochava’s defense is that the FTC’s allegations are “overtly politicized” and “factually inept” because they rely on “bankrupt assumptions.”
