Clerk's Default Sought vs. Lord & Taylor for Failing to Answer TCPA Complaint

Plaintiff Ruhi Reimer seeks the entry of a clerk’s default against Lord & Taylor for failing to respond to his July 11 first amended class action complaint seeking damages for the retailer’s Telephone Consumer Protection Act and Virginia Telephone Privacy Protection Act, said his motion Wednesday (docket 1:23-cv-00741) in U.S. District Court for Eastern Virginia in Alexandria. Lord & Taylor was properly served Aug. 9, and its responsive pleading was due Aug. 20, said the motion. Reimer alleges Lord & Taylor hounded him with at least eight unwanted promotional text messages after he asked the retailer to stop (see 2306080039).
