U.S. District Judge Alvin Hellerstein for Southern New York in Manhattan scheduled an initial dial-in conference for Sept. 29 at 10 a.m. EDT in Comcast’s case against MaxLinear, said Hellerstein’s signed order Wednesday (docket 1:23-cv-04436). Comcast is seeking a preliminary injunction to bar MaxLinear from walking away from its contractual obligations to supply chips for Comcast’s broadband gateways (see 2305300045). MaxLinear committed to continue supplying the chips, but only through Aug. 16, in return for Comcast's agreement to withdraw its motion for a temporary restraining order.

Comcast and MaxLinear propose an expedited schedule to resolve Comcast’s application for a preliminary injunction to bar MaxLinear from walking away from its contractual obligations to supply chips for Comcast’s broadband gateways (see 2305300045), the companies wrote U.S. District Judge Alvin Hellerstein for Southern New York in Manhattan in a joint letter Thursday (docket 1:23-cv-04436). Time is of the essence, because MaxLinear committed to continue supplying the chips for Comcast's broadband gateways, but only through Aug. 16, in return for Comcast's agreement to withdraw its motion for a temporary restraining order. Under the proposed schedule, MaxLinear would file its brief in opposition to the injunction by July 14, said the letter. Comcast’s reply would be due Aug. 9, it said. The companies also want Hellerstein to set a hearing on Comcast’s injunction application by Aug. 16, said the letter.

Qualcomm is entitled to summary judgment in the antitrust multidistrict litigation against the chipmaker because the plaintiffs “have no evidence supporting a standalone exclusive dealing claim,” and that’s “all that remains” in the MDL, said Qualcomm’s motion Friday (docket 3:17-md-02773) in U.S. District Court for Northern California in San Francisco. The allegation “is no longer viable” that Qualcomm tried to “undercut” chip rivals by charging lower chip prices that it would then make up for through excess royalties, it said.

Gordon Moore, 95, Intel co-founder, died March 24 at his Hawaii home, announced the company and the Gordon and Betty Moore Foundation. He was 95. Cause of death wasn’t disclosed. In 1965, Moore predicted the number of transistors on an integrated circuit would double every year, which became known as Moore’s Law. Three years after that prediction, he and colleague Robert Noyce established Intel. The two had worked under William Shockley, who co-invented the transistor and founded Shockley Semiconductor. Moore and Noyce later were among the co-founders of Fairchild Semiconductor. At Intel, Moore held various executive positions, including CEO, chairman and chairman emeritus. He stepped down as emeritus in 2006. He and his wife formed the Gordon and Betty Moore Foundation in 2000. His survivors include his wife, Betty Irene Whitaker, two sons, Kenneth and Steven, and four grandchildren.
