The Bureau of Industry and Security has posted the public comments on its proposed rule to add to the Commerce Control List (CCL) certain military vehicles and related items that the President determines no longer warrant control under the U.S. Munitions List (USML). BIS received only two public comments on this proposed rule. The proposed rule would revise USML Category VII (military ground vehicles and related articles) to narrow the articles controlled on the USML and make this list of items more positive. At the same time, BIS re-proposed the creation of five new 600 series ECCNs to control articles removed from Category VII that would instead be controlled by the CCL. This rule does not propose any tiering.
The Bureau of Industry and Security has issued a correction to its January 9, 2012 final rule that imposes a license requirement on exports and reexports to all destinations other than Canada of two types of microwave and millimeter wave electronic components. The two components are packaged high electron mobility transistors (HEMT) and packaged microwave “monolithic integrated circuits” (MMIC) power amplifiers. The correction adds a compliance date of February 9, 2012 in order to provide exporters and reexporters sufficient time to comply. As a result of this change, only exports and reexports on or after February 9, 2012 are affected by the licensing requirement imposed in new ECCNs 3A982, 3D982, and 3E982. (Note that the final rule still took effect on January 9, 2012.)

Written comments on the proposed rule were due by December 22, 2011.

The State Department is also not proposing any tiering at this time, and is still developing its definition of "Specially Designed."
