The Bureau of Industry and Security made several corrections to its June 5 final rule implementing changes to export controls on chemicals and biological agents agreed to at the Australia Group (see 13060406). The changes affect the rule’s description of the Australia Group amendments (but not the actual regulations) for ECCN 1C351. BIS is also correcting changes it made to the Export Administration Regulations for ECCN 2B352.

The Bureau of Industry and Security’s May 1 webinar on Export Control Reform changes to the Automated Export System is now available online (here). During the webinar, Gerry Horner, director of BIS’s Office of Technology Evaluation, said BIS is moving predeparture filing programs into AES around the weekend of October 12. This will allow users to file in AES by October 14, thus meeting their 24-hour requirement for shipments leaving the U.S. on October 15, Horner said.

The rule also includes transition elements (see 13041518) and a new specially designed definition (see 13041616).
The State and Commerce Department’s concurrent final rules detailing the first moves in Export Control Reform feature a revised “specially designed” definition, covering items on both the U.S. Munitions List and the Commerce Control List. The rule, published April 16, keeps the “catch and release” format for specially designed from the June 2012 proposed rule (see 12061802).
